How can the award of a public contract be challenged?
An unsuccessful tenderer may challenge the award of a public contract by way of a pre-contractual interim application before the contract is signed, or by a contractual interim application or an action contesting the validity of the contract once it has been concluded, subject to strict time limits.
What is the difference between an established civil servant and a contract agent in the public service?
An established civil servant is appointed to a grade within the public service and enjoys protective statutory status, whereas a contract agent is engaged under a public law contract, for a fixed or an indefinite term, subject to distinct rules.
What remedies are available where an administrative contract is terminated?
A party contracting with a public body whose contract is terminated may challenge that decision before the administrative courts and seek, where appropriate, compensation for the loss resulting from an unlawful termination.
What is a public housing office (OPH)?
A public housing office (*office public de l’habitat*) is an administrative public body attached to a local authority and responsible for the construction, management and allocation of social housing.
